This is an agreement between Renu Health, LLC (“RenuHealth”) and users of RenuHealth.net (“Users”) to provide health improvement information for the sole purpose of educating Users on wellness and disease management.
Users understand that their relationship to RenuHealth, and its owners, officers, directors, managers, members, employees, agents, licensors, and suppliers is not a physician-patient relationship.
Users also understand that by accessing or using RenuHealth.net, Users agree to be bound by the terms and conditions of this Agreement.
AGREEMENT
The RenuHealth.net web site is an online information and communications service. The service is offered to Users subject to their acceptance of and compliance with these terms and conditions as presented herein (the "Agreement"). By accessing or using RenuHealth.net, Users agree to be bound by the terms and conditions of this Agreement. USERS AGREE THAT THEY SHALL DEFEND, INDEMNIFY, SAVE AND HOLD RENUHEALTH, AND ITS OWNERS, OFFICERS, DIRECTORS, MANAGERS, MEMBERS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS (COLLECTIVELY “INDEMNIFIED PARTIES”) HARMLESS FROM ANY AND ALL DEMANDS, LIABILITIES, LOSSES, COSTS AND CLAIMS, INCLUDING ATTORNEY'S FEES AND COSTS ASSERTED AGAINST RENUHEALTH, AND INDEMNIFIED PARTIES THAT MAY ARISE OR RESULT FROM ANY INFORMATION OR SERVICE PROVIDED OR PERFORMED BY RENUHEALTH. USERS HEREBY FOREVER RELEASE AND WAIVE ALL CLAIMS USERS MAY HAVE AGAINST RENUHEALTH, AND INDEMNIFIED PARTIES.
ONLINE COMMUNICATIONS
RenuHealth does not warrant against human and machine errors, omissions, delays, interruptions or losses, including loss of data. RenuHealth cannot and does not guarantee or warrant that files obtained from this site or electronic email received from this site will be free of infection by viruses, worms, Trojan horses, or other code that manifest contaminating or destructive properties. RenuHealth does not warrant or guarantee that the functions or services performed by RenuHealth.net will be uninterrupted or error-free or that defects in RenuHealth.net will be corrected.
LIMITATION OF LIABILITY
RENUHEALTH, AND ITS OWNERS, OFFICERS, DIRECTORS, MANAGERS, MEMBERS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS ARE NOT LIABLE IN ANY FORM FOR ANY OUTCOME OR DAMAGES RESULTING FROM INFORMATION OBTAINED THROUGH RENUHEALTH.NET IN EITHER DIRECT OR INDIRECT FORM. RENUHEALTH SPECIFICALLY EXCLUDES ANY CONSEQUESTIONAL DAMAGES OR DAMAGES FROM PERSONAL INJURY. USERS CANNOT HAVE ANY CAUSE-OF-ACTION AGAINST RENUHEALTH, AND ITS OWNERS, OFFICERS, DIRECTORS, MANAGERS, MEMBERS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS WHETHER THE INFORMATION PROVIDED WAS USED AS DIRECTED OR OTHERWISE. RenuHealth is not responsible for the content of linked third-party sites, sites framed within RenuHealth.net, or third-party advertisements, and does not make any representations regarding their content or accuracy. Any use of third-party websites is at Users’ own risk and subject to the terms and conditions of use for such sites. RenuHealth does not endorse any product, service, or treatment advertised on RenuHealth.net.
CHANGES TO THIS AGREEMENT
RenuHealth reserves the right to modify the terms and conditions of this Agreement at any time, and such modifications shall be effective immediately upon posting of the modified Terms of Use & Disclaimer. Users agree to review this Agreement periodically to be aware of such modifications. Users’ continued access or use of RenuHealth.net shall be legal evidence of their conclusive acceptance of this Agreement as it appears at the time of access or use.
MISCELLANEOUS
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, USA. Users consent to the exclusive jurisdiction and venue of courts in Pierce County, Washington, United States, in all disputes arising out of or relating to use of RenuHealth.net. Any cause of action or claim Users may have with respect to RenuHealth must be commenced within one (1) year after the claim or cause of action arises. If either party shall commence legal action to enforce any provision of this Agreement, the Court shall award to the prevailing party all reasonable attorney’s fees and all costs incurred in connection therewith, including fees and costs on appeal.
NOTICE
RenuHealth may deliver notice to Users under this Agreement by means of electronic mail, a general notice on RenuHealth.net, or by written communication delivered by first class U.S. mail. Users may give notice to RenuHealth at any time by letter delivered by first class postage prepaid U.S. mail or overnight courier to the following address:
